Under the Papua New Guinea trade mark legislation, it is a requirement for every applicant to nominate an address for service that is based in the country. For local applicants, this is not a problem as they themselves can be the address for service. For foreign clients, they need to nominate someone they can rely on to provide that service.
The work of being an address for service seems like a pretty simple task. And it probably is. But the real crux of being the address for service is really how efficient you can be in providing that service. Deadlines in intellectual property is critical. You miss it and you’re at risk of losing your rights. If you’re a foreign firm assisting a rights holder, you could also be at risk of negligence. That is why being the address is critically important.
Here at Vai IP, we’ve tried to place a lot more emphasis on this simple but important task by ensuring our systems and process in collecting and dispatching correspondence from the Registry is done in a timely manner.
Obviously, the more documents you have the more it takes to sort them and subsequently dispatch them but ideally, we’re looking at dispatching in the week we receive them.
But we’ve also placed a lot of emphasis on technology which means we’re able to dispatch them via email too followed by the regular post if the client so desires.
Perhaps the biggest plus for our address for service is the storage of these documents and the easy access to these documents should the client require a copy of a certain document. Our system has the ability to search through the documents sent and provide us the relevant document or batch of documents in real time!
This we think should make it more convenient and save time and costs in getting copies from the Registry. Remember that a lot of the dealings with the Registry is done physically and not online so it’s always going to cost to approach the Registry.
